Terms and Conditions

These terms apply to purchases made through ateljekocica.com. The seller is ATELJE KOČICA, Jirek Kočica s.p., Kebetova ulica 34, 1000 Ljubljana, Slovenia, registration number 6167357000, tax number 11298901. The seller is not registered for VAT; no VAT is charged, pursuant to Article 94(1) of the Slovenian VAT Act (ZDDV-1).

Orders and formation of contract

Works are unique. When an order is placed the work is reserved and is no longer available to other buyers. The contract is concluded when the seller receives payment in full. If payment does not arrive within a reasonable period, the seller may cancel the order and return the work to sale.

Prices and payment

Prices are in euros and include all charges. No VAT is added (see above). Payment is by bank transfer to the account provided when the order is placed, together with a payment reference. Always quote the reference, otherwise the payment cannot be matched to your order.

Delivery

Delivery method and cost are agreed individually for each work, as sculptures vary considerably in size and weight. Collection in person at the studio in Ljubljana is possible by arrangement. The seller will contact you about delivery once payment has been received.

Right of withdrawal (14 days)

A consumer has the right to notify the seller within 14 days of receiving the goods that they are withdrawing from the contract, without needing to give a reason. Send notice to jiri.kocica@gmail.com or to the registered address above.

Return the goods undamaged and in unchanged quantity within 14 days of giving notice. The consumer bears the direct cost of returning the goods. As these are sculptures, we recommend careful packing and agreeing the return method before shipping.

The seller will refund payments received no later than 14 days after receiving the notice of withdrawal, to the same account the payment was made from.

**Exception:** the right of withdrawal does not apply to works made to order or personalised to the buyer's specifications (for example a portrait, an inscription, or a special edition), in accordance with the Slovenian Consumer Protection Act.

Conformity of goods

The seller is liable for lack of conformity in accordance with the Slovenian Consumer Protection Act. Sculptures are made by hand; minor variation in colour, patina or material texture is characteristic of handmade work and does not constitute a defect.

Complaints and dispute resolution

Complaints may be sent to jiri.kocica@gmail.com. We respond as quickly as possible.

The seller does not recognise any provider of out-of-court consumer dispute resolution as competent to resolve consumer disputes. Any disputes will be resolved by the competent court in Ljubljana.

Personal data

Personal data provided when ordering (name, email, telephone, delivery address) is used solely to fulfil and deliver the order, and is retained only as long as necessary to perform the contract and meet legal obligations. Data is not passed to third parties, except to a delivery provider where necessary to ship the work.
